Will Trump garnish the White House with the Birther issue over Obama legitimacy as an US citizen?

I think if Trump was really serious he would file a lawsuit, pressing the President to prove his birth. Maybe then Trump could have his case thrown out of court like all the others did and even be forced to pay a $20,000 fine for harment like Orly Taitz.
