Can I send my working Xbox 360 to Microsoft to get new one or fix it?

I got my new Xbox 360 few weeks ago and I found my Xbox 360 manufactured date and it was manufactured on 11-16-06! My Xbox 360 seems fine and still in good condition and no errors. I put it in very open space and well-ventilated. I let my Xbox 360 stands vertically because I bought Pelican Fan Stand for more cooling, but there is one problem in my new Xbox 360. It is my Xbox 360's dvd drive! My new Xbox 360 is built with Samsung-Toshiba DVD Drive. I bought Dead or Alive 4 and there's no scratches and still new. Few weeks until now, I found out DOA 4 disc has some scratches(little circle, not BIG ONES), but my Xbox 360 still reads my DOA 4 disc. Is my Xbox 360's defective or not?
